Terms of Service

FOCUS, available at thestayfocusapp.com, is operated by HerTech Media, LLC ("we", "us"). By creating an account or using FOCUS, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use FOCUS.

You need an account to use FOCUS. You can sign up with an email address and password or with Google. You must provide accurate information and be old enough to form a binding agreement where you live.

You are responsible for keeping your sign-in details secure and for activity under your account. Tell us promptly at herdigitalpath@gmail.com if you believe your account has been used without permission.

You agree not to:

• Break the law or infringe the rights of others.
• Try to access other users' data or get around security measures.
• Disrupt, overload or reverse engineer the service.
• Upload malware or illegal content, or use FOCUS to send spam.
• Resell or misuse the service or its AI features.

You keep all rights to the content you submit to FOCUS, including tasks, notes, projects, goals, ideas, captures and files. We do not claim ownership of it. You give HerTech Media, LLC only the permission needed to operate the service for you: to store, process, transcribe, organize and display your content. You are responsible for your content and must have the right to use it.

FOCUS helps you organize your work but does not guarantee that reminders, schedules or organization are complete. You remain responsible for your own deadlines and commitments. Files you upload (up to 20 MB each) are stored privately in your workspace; only upload files you have the right to share.

FOCUS provides organizational and productivity assistance. AI-generated classifications, dates, priorities, suggestions and organization may contain errors. You are responsible for reviewing AI suggestions before relying on them; they are only saved when you confirm them.

FOCUS is not a medical, legal, financial, educational, employment or other professional decision-making service, and it does not make decisions on your behalf.

Connecting Google Calendar is optional. Google Calendar is a third-party service, and your use of it is also subject to Google's applicable terms and policies. FOCUS is not owned, operated, sponsored or endorsed by Google. You can disconnect at any time in Settings → Calendar & Integrations. See the Privacy Policy for how calendar information is handled.

FOCUS relies on third-party services such as hosting, authentication, storage, speech-to-text and AI processing, and Google Calendar. We are not responsible for third-party services, and their own terms may apply.

FOCUS, including its software, design and branding, belongs to HerTech Media, LLC and its licensors. These Terms give you a personal, limited, non-transferable right to use FOCUS and do not transfer any ownership to you.

We aim to keep FOCUS available, but we do not promise that it will be uninterrupted or error-free.

We may add, change or remove features over time. We may also update these Terms; when we make material changes, we will update the "Last updated" date. Continuing to use FOCUS after changes means you accept the updated Terms.

You may stop using FOCUS at any time and request account deletion at herdigitalpath@gmail.com. We may suspend or end your access if you seriously or repeatedly break these Terms, or if required by law. After your account ends, your content will be handled as described in the Privacy Policy.

FOCUS is provided "as is" and "as available", without warranties of any kind, to the fullest extent allowed by law.

To the fullest extent allowed by law, HerTech Media, LLC is not liable for indirect, incidental, special or consequential damages, or for lost data, profits or missed deadlines, arising from your use of FOCUS.

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules.
